Is a buyer rebate legal in California?
Yes. No California statute prohibits a broker from rebating part of a commission to a buyer, and the Department of Real Estate recognizes the practice as lawful. The single requirement is written disclosure, under Business and Professions Code section 10176(g), which we provide to all parties. Financed buyers have the rebate disclosed to the lender and credited up to closing costs. Cash buyers face no limit.
Frequently asked questions
Is the rebate taxable?
Generally no. The IRS treats it as a price reduction, not income, so no 1099 is issued in most cases. Confirm with your tax advisor.
Do I give up service for a lower fee?
No. You get full broker representation from offer to close. You simply stop overpaying for it.
What if the seller offers a low buyer-agent commission?
Your rebate is figured on whatever commission is offered, minus our flat fee, and we disclose that scenario in writing before any offer.
